Commerce Initiates Antidumping Duty New-Shipper Review of Freshwater Crawfish Tail Meat from China
November 5, 2009On September 15, 2009, the Department of Commerce (Commerce) received a request to conduct a new-shipper review of the antidumping duty order on freshwater crawfish tail meat from China. In accordance with section 751(a)(2)(B) of the Tariff Act of 1930, as amended (the Act), and 19 CFR 351.214(d), Commerce is initiating an antidumping duty new-shipper review.
Commerce published the antidumping duty order on freshwater crawfish tail meat from China in the Federal Register on September 15, 1997 (62 FR 48218). On September 15, 2009, Commerce received a timely request for a new-shipper review of the antidumping duty order on freshwater crawfish tail meat from China from Nanjing Gemsen International Co., Ltd. (Nanjing Gemsen). On October 13, 2009, Nanjing Gemsen submitted additional information to supplement its request for a new-shipper review. Nanjing Gemsen certified that it is the exporter of the subject merchandise upon which the request for a new-shipper review is based.
Commerce conducted a query of the U.S. Customs and Border Protection (CBP) database to confirm that Nanjing Gemsen’s shipment of subject merchandise had entered the United States for consumption and had been suspended for antidumping duties. Commerce also corroborated Nanjing Gemsen’s assertion that it made subsequent shipments to the United States by reviewing CBP data. Commerce did not receive comments from the Crawfish Processors Alliance (the petitioner) on Nanjing Gemsen’s request for a new-shipper review. Commerce has found that Nanjing Gemsen’s request meets the threshold requirements for initiation of a new-shipper review for the shipment of freshwater crawfish tail meat from China.
The period of review for the new-shipper review is September 1, 2008, through August 31, 2009. Commerce intends to issue the preliminary results of the review no later than 180 days from the date of initiation and final results of this review no later than 270 days from the date of initiation.
