Commerce Conducts Review of Antidumping Duty of Folding Metal Tables and Chairs from China

The Department of Commerce (Commerce) is conducting an administrative review of the antidumping duty order on folding metal tables and chairs (FMTCs) from the People’s Republic of China (China) covering the period June 1, 2007, through May 31, 2008, and one respondent. Commerce has preliminarily determined that New-Tec Integration (Xiamen) Co., Ltd. (New-Tec), did not make sales in the United States at prices below normal value (NV) during the period of review. If these preliminary results are adopted in the final results of this review, Commerce will instruct U.S. Customs and Border Protection (CBP) to liquidate entries of merchandise exported by New-Tec during the period of review without regard to antidumping duties.

Commerce is inviting comment from interested parties on these preliminary results. The department intends to issue the final results no later than 120 days from the date of publication of this notice, July 7, 2009, pursuant to § 751(a)(3)(A) of the Tariff Act of 1930, as amended (‘‘the Act”). The products covered by this order consist of assembled and unassembled folding tables and folding chairs made primarily or exclusively from steel or other metal. The products are currently classified in Chapter 94 of the Harmonized Tariff Schedule of the United States (HTSUS) under Subheadings 9401.71.0010, 9401.71.0030, 9401.79.0045, 9401.79.0050, 9403.20.015, 9403.20.0030, 9403.70.8010, 9403.70.8020, and 9403.70.8030. While the HTSUS subheading is provided for convenience and customs purposes, Commerce’s written description of the subject merchandise governs the scope of these investigations.
